Thank you for visiting FED Learning Center (“FED”) website. This Privacy Policy tells you how we use, process, and disclose your information, including personal information, collected at this site and that you may supply to us.

Please read this Privacy Policy before using the site or submitting any personal information. By using the site, you are accepting the practices described in this Privacy Policy. These practices may be changed, but any changes will be posted and changes will only apply to activities and information on a going forward, not retroactive basis. You are encouraged to review the Privacy Policy whenever you visit the site to make sure that you understand how any personal information you provide will be used.

When this policy mentions FED, “we,” “us,” or “our,” it refers to FED Learning Center, which is responsible for your information under this Privacy Policy (the “Data Controller”).

Collection of Information

We collect personally identifiable information, like names, postal addresses, email addresses, and purchase information. The information you provide is used to fulfill your specific request and then places you on our mailing list. We never sell your information to any other company or agency. Below, we describe more specifically how we collect your information and what we do with it.

  1. Information You Give to Us.
  • Information that is necessary for the use of the website. We ask for and collect personal information about you when you use our website, sign up for an account, and make purchases. This information is necessary for the adequate performance of any contract between you and FED and to allow us to comply with our legal obligations. This information is also necessary for any contract you may have with FED and for FED’ legitimate business purposes.
  • Information you choose to give us and communications with FED. When you communicate with FED, submit information to FED for purchasing goods and services from FED, or open an account with FED, we collect information about your communication or submission and any information you choose to provide. This information is necessary for the adequate performance of any contract between you and FED and to allow us to comply with our legal obligations. This information is also necessary for any contract you may have with FED and for FED’ legitimate business purposes.
  • Additional Information. In addition to the information noted above, you may choose to provide us with additional personal information. This additional information will be processed based on your consent.
  1. Information We Automatically Collect from Your Use of the Website.

We automatically collect information, including personal information, about the goods and services you use and how you use them. This information is necessary for the adequate performance of the contract between you and FED, to enable us to comply with legal obligations, and given our legitimate interest in being able to provide and improve the functionalities of the website.

  • Cookie/Tracking Technology. FED uses cookie and tracking technology. Cookie and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the website, and understanding how visitors use the website. Cookies can also help customize the website for visitors. Personal information cannot be collected via cookies and other tracking technology; however, if you previously provided personally identifiable information, cookies may be tied to such information. Aggregate cookie and tracking information may be shared with third parties.
  1. Information We Collect from Third Parties.

We may collect information, including personal information, that others provide about you, or obtain information from other sources and combine that with information we collect. We do not control, supervise, or take responsibility for how the third parties providing your information process your personal data, and any information request regarding the disclosure of your personal information to us should be directed to such third parties.

  • Third Party Services. In addition, If you link or connect with a third party service (e.g., Google or Facebook), the third party service may send us information such as your registration and profile information. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.
  1. Other Sources.

To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive credit check results (with your consent where required) or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts.

Use of Information

We use, store, and process information, including personal information, about you to provide, understand, improve, and develop the FED website, communicate with you, facilitate a contract or purchase order with you, and comply with our legal obligations. Specifically, we use, store, and process information to:

  • Enable you to access and use the FED website;
  • Operate, protect, improve, and optimize the FED website, such as by performing analytics and conducting research;
  • Effectuate a contract or purchase order with you and provide customer service;
  • Send you substantive content we believe is of interest to you, service or support messages, updates, security alerts, and account notifications;
  • Comply with our legal obligations;
  • We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when: (1) permitted or required by law; or (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or (3) investigating fraud which has already taken place; and
  • Enforce our Website Terms and Conditions and other policies.

Sharing Your Information

  1. Your Consent.

Where you have provided consent, we may share your information, including personal information, as described at the time of consent.

  1. Compliance with Law, Responding to Legal Requests, Preventing Harm and Protection of Our Rights.

FED may disclose your information, including personal information, to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law or if such disclosure is reasonably necessary: (i) to comply with our legal obligations; (ii) to comply with legal process and to respond to claims asserted against FED; (iii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any of our users or customers to legal liability; (iv) to enforce and administer our Terms and Conditions; or (v) to protect the rights, property, or personal safety of FED, its employees, and members of the public.

Where appropriate, we may notify you about legal requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law; or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon FED.

  1. Service Providers.

FED uses a variety of third party service providers to help us provide services related to the website. Service providers may be located inside or outside of the European Economic Area (“EEA”). These providers have limited access to your information to perform tasks on our behalf, such as website and software optimization, and are contractually bound to protect and to use it only for the purposes for which it was disclosed and consistent with this Privacy Policy. FED will need to share your information, including personal information, in order to ensure the adequate performance of any contract with you and given our legitimate interest in being able to provide and improve the functionalities of the website.

  1. Business Transfers.

If FED undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information, in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a substantively different privacy policy.

  1. Aggregated Data.

We may also share aggregated information (information about our users that we combine so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

  1. Managing Your Information.

Through your account you can manage certain settings, such as to subscribe or unsubscribe to content.

  1. Rectification of Inaccurate or Incomplete Information.

You have the right to ask us to correct inaccurate or incomplete personal information concerning you.

  1. Data Access and Portability.

In some jurisdictions, applicable law may entitle you to request copies of your personal information held by us. You may also be entitled to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).

  1. Data Retention and Erasure.

We generally retain your personal information for as long as is necessary for the performance of a contract or purchase order with you and to maintain your account, for our legitimate business interests, or to comply with our legal obligations. If you no longer want us to use your information you can request that we erase your personal information. Please note that if you request the erasure of your personal information:

  • We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety;
  • We may retain and use your personal information to the extent necessary to comply with our legal obligations;
  • Some copies of your information (e.g., log records) may remain in our database but are disassociated from personal identifiers; and
  • Residual copies of your personal information may not be removed from our backup systems for a limited period of time.
  1. Withdrawing Consent and Restriction of Processing.

Where you have provided your consent to the processing of your personal information by FED you may withdraw your consent at any time by changing your account settings or by sending a communication to FED specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal. Additionally, in some jurisdictions, applicable law may give you the right to limit the ways in which we use your personal information, in particular where (i) you contest the accuracy of your personal information; (ii) the processing is unlawful and you oppose the erasure of your personal information; (iii) we no longer need your personal information for the purposes of the processing, but you require the information for the establishment, exercise, or defense of legal claims; or (iv) you have objected to the processing and pending the verification of whether the legitimate grounds of FED in processing the information override your interests.

  1. Objection to Processing.

In some jurisdictions, applicable law may entitle you to require FED not to process your personal information for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing, FED will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defense of legal claims.

Where your personal information is processed for direct marketing purposes, you may, at any time, ask FED to cease processing your data for these direct marketing purposes.

  1. Lodging Complaints.

You have the right to lodge complaints about the data processing activities carried out by FED before applicable competent data protection authorities.

Operating Globally

  1. General.

To facilitate any global operations FED may perform, FED may transfer, store, and process your information within our company or with service providers based in Europe, India, Asia-Pacific, and North and South America. Laws in these countries may differ from the laws applicable to your Country of Residence. For example, information collected within the EEA or concerning EEA residents may be transferred, stored, and processed outside of the EEA for the purposes described in this Privacy Policy. Where we transfer, store, and process your personal information outside of the EEA we have ensured that appropriate safeguards are in place to confirm an adequate level of data protection.

In some jurisdictions you may contact your European Data Protection Authority or Commission.

  1. California & Vermont Residents.

FED will not share information it collects about you with its affiliates or third parties (both financial and non-financial), except as required or permitted by your state’s law.

  1. California Privacy Rights.

California law permits California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties. See the Privacy Contact Information section for where to send such requests. FED does not share personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.

Security

We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration. Some of the safeguards we use to protect your information are firewalls and data encryption and information access controls. If you know or have reason to believe that your FED credentials have been lost, stolen, misappropriated, or otherwise compromised, or in case of any actual or suspected unauthorized use of your FED account, please contact us following the instructions in the Privacy Contact Information section below.

Your personally identifiable information is kept secure. Only authorized employees, agents, and contractors who have agreed to keep information secure and confidential have access to this information. All emails and newsletters from this site allow you to opt out of further mailings.

Changes to This Privacy Policy

FED reserves the right to modify this Privacy Policy at any time in accordance with this provision. If we make changes to this Privacy Policy, we will post the revised Privacy Policy on our website and update the “Last Updated” date at the top of this Privacy Policy. If you disagree with the revised Privacy Policy you should refrain from visiting our website. Your continued access to or use of the website will be subject to the revised Privacy Policy.

Waivers

I acknowledge that I am a fire and life safety professional who desires to engage with the FED Learning Center, which provides fire and life safety training.

By clicking “I Accept” I agree to:

  • Engagement Waiver: I understand that I must be logged in to my personal member profile on FEDLearningCenter.com (www.FEDLC.com) to access and engage with any training activity or material including but not limited to knowledge checks, quizzes, supporting materials, certificates, and CEUs.  This means that all participants must have access to a smart device for all courses, including all in-person events.
  • Identity Verification Waiver: I agree to enter only true and current information about myself on my personal member portal.  I understand that my profile on FEDLearningCenter.com (www.FEDLC.com) is specific to me and all access and engagement is exclusive to my use.  I agree to provide proof of ID at all in-person events.
  • 3rd Party Proctoring Waiver: I understand that all FED Learning Center in-person events will be proctored by a 3rd party; meaning that both an instructor and another individual will be present.  This 3rd party proctor will verify ID upon sign-in and act as witness that the person taking the course and subsequent quiz within the online member portal is in fact the registered and signed-in person.
  • Participation Waiver: I understand that if more than 10% of the course is missed, I will be asked to retake the class at my own expense to be awarded the Certificate of Completion/ Certification and CEUs.
  • Cancellation of Participation by Member Waiver: I understand that if I cancel my training registration six (6) days or less from the first course date, no refund will be given. Rescheduling may not be permitted.
  • Cancellation of Offering Waiver: I understand that the FED Learning Center reserves the right to cancel any course or offering at any time without notice.  In the event a cancellation is required for any reason, all registered participants will be notified as soon as possible before the start of that course.
  • Satisfaction Guarantee Waiver: I understand that if I am not satisfied with a course by that course’s midpoint I can notify the FED Learning Center for a full refund. 
  • Media Waiver: I agree that the FED Learning Center may take and use photographs and videos of myself and my parties without compensation for their business purposes, including but not limited to their website, printed collateral, marketing and other purposes during in-person events.
  • Communication Waiver: I agree to receive text, email and phone messages from the FED Learning Center representatives.
  • Information Release to Employer Waiver: I understand that I may request to associate my member profile with my employer’s corporate profile.  If my employer also agrees to associate profiles, that thereby grants the employer (corporate member) visibility of all of my student information including training discipline(s), date(s), quiz score(s), certificate(s) and CEU(s).
  • Certification versus Certificate of Completion Waiver: I understand that the FED Learning Center differentiates successful participation of In-Person Hands-On Courses with Certification versus Virtual Live and Virtual On-Demand Courses as Certificate of Completion due to instructor visibility of performance with equipment.
  • Quiz Scoring Waiver: I understand that I must achieve an 80% or greater on each quiz to achieve my Certificate and my CEUs.  In the event that 80% is not achieved I will be allowed to retake the quiz an additional two (2) times for a total of three (3) tries.  If 80% or better is still not achieved I understand I must retake the course segment. 
  • Material Copyright Waiver: I understand that the material provided by the FED Learning Center is for the registered user only.  No permission is granted to share print, copy, reproduce, distribute, transmit, upload, download, store, stream in groups, alter, or modify the content contained in this resource.
  • COVID-19 Waiver: I agree that I will abide by all safety and health rules and regulations of the FED Learning Center, including but not limited to mask mandates, vaccine requirements, testing requirements, and others during in-person events.
  • Safety Measures Waiver: I agree that I will abide by all safety rules and regulations of the FED Learning Center, including but not limited to using the proper tools, wearing eye protection, and others during in-person events.
  • Training Purposes Waiver: I agree that the information at the FED Learning Center is provided for education and information purposes only. I acknowledge, agree and understand that I should always use my best judgment and follow manufacturer instruction. In no event shall the FED Learning Center be liable for my actions, judgments, instructions or decisions in the field.
  • Product and Parts Pricing Confidentiality Waiver: I understand that the pricing for products and parts in the fire protection industry are confidential between my company and supplier and I agree that I will not disclose any product pricing information with any third party during a FED Learning Center event.
  • Liability Waiver: I acknowledge and agree that I have reviewed the Liability Waiver and Release, available at fedlearningcenter.com and agree to all of its terms.

Program Policy

  • Engagement Policy

The participant understands that each member has a personal and unique student portal and all access and engagement must be made through their personal portal by logging in to www.FEDLearningCenter.com (www.FEDLC.com) to access and engage with any training activity or material including but not limited to knowledge checks, quizzes, supporting materials, certificates, and CEUs.  This means that all participants must have access to a smart device for all courses, including all in-person events.

  • Identity Verification Policy

The participant understands that they are to only use true and current information about themselves on their personal member portal. They understand that their profile on www.FEDLearningCenter.com (www.FEDLC.com) is specific to them and all access and engagement is exclusive to their use. They understand that they are who they say they are and that they must provide proof of ID by showing a valid state-issued ID at all in-person events.

  • 3rd Party Proctoring Policy

Participant understands that all FED Learning Center in-person events will be proctored by a 3rd party; meaning that both an instructor and another individual will be present. This 3rd party proctor will verify ID upon sign-in and act as a witness that the person taking the course and subsequent quiz within the online member portal is in fact the registered and signed-in person.

  • Participation Policy

Participant acknowledges and agrees that if more than 10% of the course is missed, Participant will be required to retake the entire class at its sole expense to be awarded a Certificate of Completion/Certification and CEUs.

  • Cancellation of Participation by Member Policy 

Participant acknowledges and agrees that if virtual or live training is canceled six (6) days or less from the first day of the course, no refund will be given. The FED Learning Center may, in its sole discretion, permit rescheduling from time to time.

  • Cancellation of Offering Policy

Participant understands that the FED Learning Center reserves the right to cancel any course or offer at any time without notice. In the event a cancellation is required for any reason, all registered participants will be notified as soon as possible before the start of that course.

  • COVID-19 Policy

Participant agrees to abide by any safety and health rules and regulations provided by the FED Learning Center, including those related to the novel coronavirus, COVID-19, such as mask mandates. Participant agrees to release and hold harmless the FED Learning Center, its officers, directors, representatives, agents, partners and staff from any and all sickness (including but not limited to COVID-19), actions, cause of action, claims, demands and/or liabilities arising out of or related in any way to Participant’s participation in the activities at the FED Learning Center.

  • Safety Measures Policy

Participant agrees to abide by any safety rules and regulations provided by the FED Learning Center. Participant agrees to release and hold harmless the FED Learning Center, its officers, directors, representatives, agents, partners and staff from any and all injury, actions, cause of action, claims, demands and/or liabilities arising out of or related in any way to Participant’s participation in the activities at the FED Learning Center.

  • Training Purposes Policy

Participant acknowledges that the information at the FED Learning Center is provided for education and information purposes only. Participant acknowledges, agrees and understands that they should always use their best judgment and follow manufacturer instruction. In no event shall the FED Learning Center be liable for any actions, judgments, instructions or decisions in the field.

  • Satisfaction Guarantee Policy

Participant acknowledges that if they are not satisfied with a course, by that course’s midpoint, they can notify the FED Learning Center for a full refund.

  • Media Policy

Participant grants the FED Learning Center and its partners the right to take and use photos and videos of Participant and its employees, without compensation for their business purposes (website, printed collateral, etc.) during in-person events.

  • Communication Policy

Participant agrees and consents to receive electronically all communications, agreements, notices, statements, disclosures and other documents that the FED Learning Center provides in connection with my training at the FED Learning Center. I acknowledge and understand that any communication I accept or agree to receive electronically will be enforceable without my physical signature on a piece of paper. I acknowledge and understand that I may withdraw my consent by calling my FED Learning Center representative and my withdrawal of consent will be effective within a reasonable period of time after it is received.

  • Information Release to Employer Policy

Participant understands that they may request to associate their member profile with their employer’s corporate profile. If their employer also agrees to associate that thereby grants the employer (corporate member) visibility of all of the participant’s student information including training discipline(s), date(s), quiz score(s), certificate(s) and CEU(s). Participant acknowledges and understands that they may withdraw their consent to associate their member profile with their employer by calling an FED Learning Center representative and request to withdraw consent.   

  • Certification versus Certificate of Completion Policy

Participant understands that the FED Learning Center differentiates successful participation of In-Person Hands-On Courses with Certification versus Virtual Live and Virtual On-Demand Courses as Certificate of Completion, due to instructor visibility of Participants performance with equipment.

  • Quiz Scoring Policy

Participant understands that they must achieve an 80% or greater on each quiz to achieve my Certificate and my CEUs. In the event that 80% is not achieved they will be allowed to retake the quiz.

  • Material Copyright Policy

Participant acknowledges and agrees that the material provided by the FED Learning Center is for the registered user only.  No permission is granted to share, print, copy, reproduce, distribute, transmit, upload, download, store, stream in groups, alter, or modify the content contained in this resource.

  • Product and Parts Pricing Confidentiality Policy

Participant agrees that the pricing for parts and products received by suppliers shall be considered confidential and Participant agrees to hold such information in strict confidence and not disclose it to any third parties during any FED Learning Center event.

  • Liability Policy

Participant understands that the FED Learning Center’s liability insurance does not provide coverage for any injury occurring to the Participants, their employers or their employees that participate in training at the FED Learning Center. Participant agrees to indemnify and hold the FED Learning Center harmless from any injury, loss, damage or cost incurred or caused by Participant, or if applicable, its employees, as a result of their presence at the FED Learning Center and participation in the training activities. Participant agrees to waive any and all claims and causes of action which it/he/she may have against the FED Learning Center arising out of participation in the training activities, including but not limited to the training materials and the training or the application of the training materials or training. Participant agrees and acknowledges that neither the FED Learning Center nor its insurance carriers shall be responsible for paying benefits or other amounts for loss or injuries to Participant or any third party resulting from such loss.
